Terms of Use

These terms govern access to Vignetra’s mobile application, website, optional accounts, metadata sync, and related services.

The Terms summary can be found in the Vignetra app’s Privacy section.

Please read these Terms. They form a binding agreement when you access or use the Service. If you do not agree, do not use Vignetra. Mandatory consumer rights that cannot legally be waived remain in effect.

1. Agreement and operator

These Terms of Use (“Terms”) are an agreement between you and the operator of the Vignetra Service (“Vignetra,” “we,” “us,” or “our”). They apply to the Vignetra mobile app, this website, optional account and metadata-sync features, support, and related services (collectively, the “Service”). The Privacy Policy explains how information is handled and is incorporated by reference where permitted.

Vignetra is currently offered under the Vignetra product name in a pre-release stage. The legal name, postal address, and governing establishment of the operating entity will appear in the applicable app-store listing and will be added here before general commercial release. Questions may be sent to info@vignetra.com.

2. Eligibility and authority

You may begin the private local guest experience without providing an age or creating an account. You must be at least 13 to create or use an online account or access cloud sync, friends, sharing, account notifications, or other social features. Vignetra does not operate a guardian-approval override for an under-13 account.

Immediately before account creation or sign-in through Apple, Google, or email/password, you must provide accurate age information and must not bypass the age warning or use another person’s account session or credentials. This is a self-declaration, not proof of age, and the declaration relies on information supplied by the person and does not independently verify identity or guarantee accuracy. An unknown or under-13 declaration ends the authentication attempt, neither creates nor enters an account, and returns you to the private local guest experience. A person who declares they are age 13 or over may continue to authentication and online features.

Vignetra may apply a higher minimum age or stronger protections when required by local law. If you use Vignetra for an organization, you represent that you are at least 18 and have authority to bind that organization, and “you” includes the organization.

You may not use the Service if doing so is prohibited by applicable law, if your access was previously terminated for a serious violation, or if you are subject to trade restrictions that prohibit access.

3. What Vignetra provides

Vignetra helps you explore media you authorize from a device library. Depending on platform, permissions, region, and release stage, features may include moments, a timeline, local visual search, location maps, calendar context, familiar-face grouping, titles, notes, preferences, optional accounts, metadata sync, friends, encrypted sharing, nested notes, hearts, notifications, saving received media, and on-device card creation.

  • Vignetra is an organization and discovery tool, not a photo or video backup service.
  • Original media remains under the control of your device photo library and may become unavailable to Vignetra if you revoke access, delete the media, change devices, remove the app, or lose the device.
  • Machine-generated search, grouping, date, place, face, and context results can be incomplete or wrong. Review results before relying on them.
  • Features may differ between iOS and Android to follow platform design, permission, and technical requirements.
  • Siri and Shortcuts are optional ways to open Ask Your Life on supported Apple devices. Their availability varies by device, operating-system version, language, and region.
  • Vignetra does not share your library automatically. A cloud copy is created only when a signed-in owner explicitly selects a moment or creates a card and chooses All friends or Selected friends.
  • Designated, non-sensitive app surfaces may display advertising that helps fund the Service. Advertising choices never limit the core moment, privacy, or friend features described in these Terms.

4. Guest use, accounts, and usernames

Guest use begins without an age check, and an account is optional for local use. Apple, Google, and email/password are Vignetra’s public authentication methods. Immediately before account creation or sign-in through any of them, Vignetra presents a self-declared 13+ eligibility warning. When you choose Apple or Google, you authorize Vignetra to receive the provider information described in the Privacy Policy. If you choose email/password, you may create an account after passing the same eligibility boundary, sign in later, and request a password-reset message. Firebase Authentication handles those credentials and reset messages; Vignetra does not receive, store, or log the raw password. The declaration is not proof of age. You are responsible for securing your device and sign-in account or credentials, for activity under your Vignetra account, and for promptly reporting suspected unauthorized access.

For sign-in, Vignetra may receive an age-eligibility result from a supported platform or determine on the device from a date-of-birth entry whether the declaration is under 13 or 13+. The date entered in the app is not stored by Vignetra. Vignetra may record only the resulting self-declared eligibility result, how it was declared, the check date, and online-access status. The declaration relies on information supplied by the person and does not independently verify identity or guarantee accuracy. An unknown or under-13 declaration returns to guest use without creating an account; a 13+ declaration may continue to authentication.

You must provide accurate information and keep it reasonably current. Your first name, username, optional 33-character About line, optional profile photo, and friend count are visible to eligible signed-in users in discovery and profile surfaces. Your friend list and moments are not public. About lines cannot contain links or @mentions. You may crop, replace, or remove your profile photo, and you may use only a photo you have the right to upload. First-name changes are limited to once every 14 days, username changes to once every 30 days, About edits and other attempts may be rate-limited, and a previous username may remain temporarily reserved for up to 90 days to deter impersonation and abuse.

Usernames are unique and may not:

  • impersonate another person or falsely suggest affiliation, endorsement, or official status;
  • misuse a trademark, brand, public figure name, government identifier, or protected organization name;
  • contain unlawful, threatening, hateful, sexually exploitative, or deliberately misleading content;
  • be reserved, sold, transferred, or automated at scale without written permission.

Vignetra may reserve, reject, rename, reclaim, or transfer a username when reasonably necessary to protect users, comply with law, prevent impersonation or abuse, resolve a verified rights claim, or protect the integrity of the Service. If you believe a protected name was reserved or assigned by mistake, contact info@vignetra.com with evidence of authority. Submitting a claim does not guarantee transfer.

5. Your content and permissions

“Your Content” includes the photos and videos you authorize; profile photo and cards you create; and titles, image descriptions, notes, names, corrected locations, feedback, and other material you provide. As between you and Vignetra, you retain ownership of Your Content.

You grant Vignetra a limited, non-exclusive, worldwide, royalty-free license to access, process, reproduce, transform, transmit, and store Your Content only as technically necessary to operate, secure, troubleshoot, and improve the features you request, consistent with the Privacy Policy. Original library media and local face or visual data are designed to be processed on your device. When you explicitly share, this license permits Vignetra and its processors to store and deliver an encrypted copy and its operational metadata for the audience you choose. Vignetra is not granted a right to use private content for advertising or general-purpose model training.

You represent that you have the rights and permissions needed to use Your Content with Vignetra and that doing so does not violate another person’s privacy, publicity, intellectual-property, contractual, or other rights. Vignetra does not take responsibility for Your Content or for how you label, search, or use it.

Private sharing and recipient copies

You may share only with accepted friends and only content you are entitled to disclose to the audience you choose. All friends includes all current and future accepted friends except blocked people. Selected friends limits access to the accepted friends you choose. Your friend list is visible only to you; other eligible users may see a friend count. For shared videos, authorized viewers may see an aggregate unique count after a friend watches for at least four seconds or completes a shorter video, but not viewer identities. Photos and cards do not have view counts. An authorized friend may intentionally revisit moments shared with them from your profile. Silencing a friend affects passive feed delivery in one direction only and does not revoke that friend’s access to moments otherwise shared with them; resuming applies only to moments shared afterward. Recipients may view, add their own notes or heart, but may not repost a received moment to their own Vignetra audience. The owner decides whether Vignetra permits recipients to save or export the shared media. Changing an audience, disabling export, removing a recipient, deleting a share, blocking a user, or deleting an account removes access through Vignetra but cannot delete a copy the recipient already saved, exported, photographed, recorded, or otherwise retained.

Shared content and notes are encrypted on the client. Vignetra prepares a private-sharing credential automatically, and its wrapping secret remains in protected device storage. Another signed-in device may need to approve a new device. Vignetra stores only device-credential metadata and encrypted recovery envelopes; it does not receive the wrapping secret or plaintext private-sharing key and cannot decrypt private content for support or moderation.

Cards

Card templates and rendering tools are provided for personal expression. You may choose an existing moment or another authorized image, arrange up to four images, reposition crops, and add an image description before the app renders the card locally. The rendered card and private details are encrypted for the audience you choose. You are responsible for the message, names, images, descriptions, and other content placed in a card. Do not use cards to impersonate another person, make false professional claims, or distribute unlawful or infringing content.

6. People, face grouping, and sensitive information

The optional People feature groups faces that appear similar within your authorized library. It is not a public identity service and must not be used for surveillance, authentication, employment, housing, credit, insurance, law-enforcement decisions, or another high-impact decision.

You may add a name only when you have a lawful basis and a legitimate personal reason to do so. You must not use Vignetra to stalk, harass, exploit, discriminate against, unlawfully identify, or expose another person, particularly a child or vulnerable person. Where local law requires consent to process biometric or face-related information, you are responsible for obtaining that consent before enabling or using the feature for that person.

Face vectors, crops, similarity groups, and persistent local face identifiers are designed to remain on the device. If you explicitly share a named moment, a share-scoped name label and its display position may be included inside the encrypted payload. Do not share a name or image with a recipient unless you have the right to do so.

7. Acceptable use

You must not, and must not help anyone else to:

  • break applicable law or violate another person’s rights;
  • access another person’s account, device, library, or metadata without authorization;
  • harass, threaten, stalk, exploit, deceive, discriminate against, or endanger a person;
  • use Vignetra to create or distribute unlawful sexual content, child sexual abuse material, intimate imagery without consent, or content that facilitates human exploitation;
  • probe, bypass, disable, or interfere with authentication, App Check, access rules, rate limits, security controls, or provider restrictions;
  • introduce malware, automated abuse, denial-of-service traffic, scraping, credential stuffing, or fraudulent transactions;
  • reverse engineer, decompile, or extract protected source code, models, keys, or service logic except to the limited extent applicable law expressly permits despite this restriction;
  • remove legal notices, attribution, rights-management information, or OpenStreetMap attribution;
  • use the Service or its outputs to develop a competing biometric identification or surveillance database;
  • misrepresent machine-generated results as verified facts about another person.
  • send spam friend requests, repeatedly contact someone who ignored a request, evade a block, or use sharing, notes, cards, or notifications to harass or pressure another person;

Vignetra may investigate suspected violations and may cooperate with providers or authorities where legally required. Account and friend-request reports are metadata-only. A report about a moment, card, or note includes that exact reported item as private evidence and immediately removes it from the reporter's feed and access pending review; the creator and other recipients retain access unless a reviewer removes the item. Included evidence is isolated from the ordinary service, access is audited, and ordinary encrypted content remains unavailable to reviewers. Reports must be made honestly and must not be used to harass, retaliate, coordinate abuse, spam, or submit material unrelated to a good-faith safety concern. Vignetra may prevent duplicate open reports, apply reasonable reporting limits, and, after a reviewer confirms deliberate misuse, warn a reporter or restrict ordinary reporting for a stated period. A report that is simply not upheld is not by itself misuse. Immediate-threat and child-safety reports remain available during a reporting-only restriction. When a reviewer explicitly confirms that a person violated policy while removing a post, restricting an account, or closing an account, Vignetra may maintain a reviewer-only history of those confirmed cases and a proportional escalation level; a report alone never creates that history. Vignetra may remove a shared item, restrict an account for a stated period, close an account indefinitely, preserve evidence where legally required, or take no action after review. A restricted or closed person may still sign in to read the reviewer notice, use on-device features, and initiate account deletion from Privacy at any time, but cannot use online social features while the action is active. Account deletion removes ordinary account and product data but does not require deletion of narrowly limited safety, fraud-prevention, legal, or compliance records that may lawfully be retained separately. Vignetra may retain one-way Apple or Google provider-identity fingerprints and a separately keyed one-way verified-email fingerprint, without the deleted account’s provider subject, raw email, name, or Vignetra UID, for the duration reasonably needed to prevent an active safety action from being bypassed through account recreation. Where reasonable and lawful, the reviewer notice explains the policy basis, action, duration or reinstatement path, and how to request review. Use blocking for immediate separation and contact local emergency services if anyone faces imminent danger.

8. License and intellectual property

Subject to these Terms, Vignetra grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on devices you own or control as permitted by the applicable app-store rules, solely for lawful personal use.

Vignetra and its licensors own the Service, including its name, logo, visual design, software, service logic, documentation, and original content, excluding Your Content. No rights are granted except those expressly stated. You may not use Vignetra branding in a way that suggests affiliation or endorsement without written permission.

Open-source components and model files are governed by their respective licenses rather than this proprietary license. Notices are available in the app under Privacy → Open Source Licenses.

Feedback

If you voluntarily send ideas or feedback, you grant Vignetra a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or payment, provided this does not grant ownership of your private photos, videos, notes, or other personal content.

9. Third-party platforms and services

The Service can rely on independent platforms and services, including Apple, Google, Firebase, Google Cloud, operating-system geocoding, and OpenStreetMap infrastructure. Their terms and privacy practices may apply to your direct relationship with them. Vignetra is not responsible for third-party service availability, content, security, or changes that are outside Vignetra’s reasonable control.

Vignetra uses Google Mobile Ads and Google’s User Messaging Platform for advertising consent, delivery, measurement, and fraud prevention, including in the guest experience before any sign-in age check. Advertising remains available whether login age eligibility is unknown, under 13, or 13+. Vignetra does not use login-age eligibility to classify, enable, disable, personalize, or otherwise reconfigure ads or ATT. Google Mobile Ads age-treatment flags remain unspecified/default for every user, and a global G content ceiling applies. Depending on location and independent UMP and ATT choices, ads may be personalized, non-personalized, limited, or technically delivered. While the release includes advertising, ATT remains integrated on iOS and Vignetra requests the system choice whenever its status is not determined; no login-age or account state suppresses that request. Apple or system restrictions may prevent the prompt from appearing or presenting again after it is answered or restricted. Ads continue under the resulting consent state. ATT is an advertising-consent choice, not age verification or online-account eligibility. The Privacy Policy explains the data involved and how to review advertising choices.

If you choose Ask by voice, your operating system’s speech-recognition service converts a short spoken question into editable text. Depending on your device, language, network, and settings, Apple, Google, or another platform speech provider may process audio and transcription data under its own terms. Voice input is optional, and typed Ask Your Life search remains available.

If you choose Siri or Shortcuts to invoke Vignetra, the operating system routes your request text to Vignetra so it can open Ask Your Life and search the photos, places, and details you have authorized. Vignetra does not provide your photo library, photo metadata, local visual indexes, face data, or search results to Siri through this feature. Apple’s independent handling of Siri and Shortcuts is governed by Apple’s terms and privacy practices.

Map data and geocoded labels can be incomplete, delayed, or inaccurate and must not be used for emergency response, navigation where safety depends on precision, property boundaries, or legal proof of location.

11. Updates, beta features, and availability

Vignetra may add, change, suspend, or discontinue a feature; impose reasonable limits; or release platform-specific updates. We will provide notice where required. Updates may be necessary for security, compatibility, or continued operation.

Pre-release, beta, experimental, or preview features may be incomplete, change without notice, and contain errors. Do not rely on them for emergencies, legal evidence, medical decisions, financial decisions, safety-critical use, or the only copy of important information.

12. Suspension, termination, and account deletion

You may stop using Vignetra at any time. You can sign out or request account deletion from the Privacy section. Account deletion removes Vignetra account metadata, encrypted shares owned by the account, and its access to received shares as described in the Privacy Policy, but does not delete original media from your device library, copies already saved by another person, or automatically cancel an app-store subscription.

Vignetra may limit, suspend, or terminate access if you materially or repeatedly violate these Terms; create security, legal, or safety risk; fail to pay for a paid service; or if required by law. Where reasonable and lawful, we will provide notice and an opportunity to appeal. Immediate action may be necessary for severe abuse or urgent risk.

Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, dispute provisions, and general terms—remain effective.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” VIGNETRA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

VIGNETRA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR COMPATIBLE WITH EVERY DEVICE; THAT SEARCH, FACE GROUPING, DATE, PLACE, NOTIFICATION, DELIVERY, ENCRYPTION, OR OTHER RESULTS WILL BE COMPLETE OR CORRECT; OR THAT LOCAL, SYNCED, OR SHARED DATA WILL NEVER BE LOST. YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF ORIGINAL MEDIA, SECURING YOUR DEVICE AND SIGN-IN ACCOUNT, AND REVIEWING IMPORTANT RESULTS.

Some jurisdictions do not allow certain warranty exclusions. In those places, exclusions apply only to the extent legally permitted, and mandatory consumer guarantees remain.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGNETRA AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, GOODWILL, OR OPPORTUNITY; LOSS, CORRUPTION, OR UNAVAILABILITY OF DATA OR MEDIA; OR THE COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIGNETRA’S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID VIGNETRA FOR THE SERVICE DURING THAT PERIOD OR (B) US $100.

These limits do not apply to liability that cannot legally be limited, which may include fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights. The limitations allocate risk and are an essential basis of the agreement.

15. Your responsibility for third-party claims

To the extent permitted by law, if your unlawful use of the Service, Your Content, or your material breach of these Terms causes a third party to bring a claim against Vignetra, you agree to reimburse Vignetra for reasonable losses, liabilities, and legal costs resulting from that claim. Vignetra will provide reasonable notice and allow you to participate in the defense, but Vignetra may control the defense and settlement. This section does not apply where prohibited by consumer law.

16. Disputes and governing law

Please contact info@vignetra.com before filing a formal claim so we can try to resolve the issue. This does not prevent either party from seeking urgent relief or using a statutory consumer or privacy complaint process.

Mandatory consumer-protection laws and courts available in your place of residence remain available where they cannot be waived. For other matters, these Terms are governed by the laws of the jurisdiction in which Vignetra’s operating entity is established, without regard to conflict-of-law principles, and disputes may be brought in the competent courts identified by that jurisdiction. The operating jurisdiction will be identified in the applicable app-store listing and on this page before general commercial release.

The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in these Terms requires individual arbitration or waives a class or representative right unless Vignetra later presents a legally valid, separately disclosed dispute agreement that you accept.

17. Apple App Store and Google Play terms

Apple App Store

If you download Vignetra from Apple’s App Store, you acknowledge that these Terms are between you and Vignetra, not Apple. Vignetra, not Apple, is solely responsible for the app and its content, maintenance and support, warranties not effectively disclaimed, product claims, legal compliance, and handling intellectual-property infringement claims. Your license is limited to use on Apple-branded products you own or control as permitted by the Apple Media Services Terms and any applicable Family Sharing or volume-purchase rules.

If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, to the extent required by its rules. Apple has no other warranty obligation to the maximum extent permitted by law. You represent that you are not located in a country subject to a US government embargo or designated as supporting terrorism and are not on a US government prohibited or restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the App Store provisions against you.

Google Play

If you download Vignetra from Google Play, Google’s applicable Play terms govern your use of Google Play, purchase administration, refunds, and device eligibility. These Terms remain between you and Vignetra regarding the app. In a conflict concerning Google Play distribution, Google Play’s required terms control to the extent required.

18. General terms

  • Changes. We may update these Terms prospectively. Material changes will receive reasonable notice where required. If you do not agree, stop using the Service before the changes take effect.
  • Entire agreement. These Terms, the Privacy Policy, purchase disclosures, and any feature-specific terms are the entire agreement about the Service.
  • Order of precedence. Feature-specific or purchase terms control only for the feature they address. Mandatory app-store terms control where the store requires.
  • Severability. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains effective.
  • No waiver. A failure to enforce a provision is not a waiver.
  • Assignment. You may not transfer this agreement without written consent. Vignetra may transfer it as part of a reorganization, financing, merger, acquisition, or sale, subject to applicable law.
  • No agency. These Terms do not create a partnership, employment, agency, or fiduciary relationship.
  • Electronic communications. You agree to receive legally permitted notices electronically through the app, website, provider email, or account contact information.
  • Language. If a translation conflicts with the English version, the English version controls to the extent permitted by law.
